I want to thank you and Robin Nadjiwan, Reference Librarian, Library of Parliament, for responding quickly to my question.

Robin asked for as much detail as possible in order to respond in a complete = and efficient maner. I would like to know:

Is approval is required from any department in the federal government for oil supertankers to navigate in the inside = waters of British Columbia from Kitimat to the Pacific = Ocean.

Robin mentioned that there are provisions in the Canada Shipping Act under the Ministry of Transportation and = referred me to section 167 for an example. I notice that section 167 is contained in:

PART 8: POLLUTION PREVENTION AND RESPONSE — DEPARTMENT OF TRANSPORT AND = DEPARTMENT OF FISHERIES AND OCEANS
= Discharges of Oil

However, = ; Mr. Walasek, on behalf of the Minister of Transport, has = advised me by email on two occasions that:

"No approval is required from Transport Canada's Marine Safety Office = for any shipment or projects."

Is approval = for any shipment required by the DEPARTMENT OF FISHERIES AND = OCEANS?

It is a frightening to think that approval is not required from any = department in the government for anyone planning to ship millions of barrels of polluting crude oil several times a week non-stop through 200 km of = often treacherous waters, endangering villages of people, wildlife, fisheries, mammals, scenery, tourism, recreation, Marine Provincial Parks and = Protected Provincial Parks between the Pacific Ocean and Kitimat, British = Columbia.

I hope that this additional information will allow Robin Nadjiwan to = respond further.

Hello Ms. Fry,

In response to your request for information on who, if anyone, must approve = the shipment of oil and gas in Canada I am including the = following.

The issue is a complicated one, it appears that the manner of shipment is = the primary factor in who is responsible.

For the shipment on the ocean there are provisions in the = Canada = Shipping Act, 2001, S.C. = 2001, c. 26, under the Ministry of Transportation, which deal with the shipment = of oil products. A copy of the Act can be found here http://www.canlii.org/ca/sta/c-10.15/, see = section 167 for an example.

For the control and licensing of pipelines the National Energy Board, = accountable to the Minister of Natural Recourses, is responsible. The = board is formed and regulated by the National Energy Board Act, R.S.C. 1985, c. N-7 a copy of which can be = found here: http://www.ca= nlii.org/ca/sta/n-7/ See = sections 71 and 72 for examples.

Imports and exports from outside of Canada might be regulated by another act and ministry, while the movement of oil and gas across country with trucks = could be another.
